New York courts apply the best interests of the child standard in every custody matter. Neither parent holds a superior claim based on gender. What courts actually weigh is more specific: the quality of each parent’s relationship with the child, the stability of each home environment, each parent’s ability to meet the child’s physical and emotional needs, each parent’s willingness to support the child’s relationship with the other parent, primary caretaker history, the strength of the emotional bond, and, when a child is of sufficient age and maturity, the child’s own preferences.

New York recognizes two forms of custody. Legal custody governs decision-making authority over education, health care, and upbringing. Physical custody determines where the child primarily resides. Either type can be shared or awarded solely to one parent, and a court can reach different conclusions on each.

Divorce and separation proceedings go before the Supreme Court, not Family Court.

An unmarried father has no standing to petition for custody or visitation in New York courts until legal paternity is established. Without it, he can’t seek a parenting schedule, participate in decisions about the child’s welfare, or contest an adoption. New York law provides three pathways.

• Presumption of Legitimacy: If the father was married to the mother at the time of the child’s birth, paternity is presumed by law
• Acknowledgment of Parentage (AOP): A voluntary form signed by both parents, typically completed at the hospital or later through the Department of Social Services
• Order of Filiation: Obtained through a Paternity Petition filed in Family Court; after filing, the court can order DNA testing to establish biological fatherhood

Once paternity is legally established, the father gains standing to seek custody and parenting time, the right to be consulted on adoption decisions, and the legal obligation to provide financial support.
