In general, Assault in the Second Degree (PL § 120.05) is a Class D Felony charged when it is alleged that the defendant intentionally caused physically injury to another person by means of a dangerous or deadly weapon. Robbery in the Second Degree (PL § 160.10) is a Class C Felony charged when it is alleged that the defendant forcibly steals property from another and during the course of that crime causes the physical injury of another person not a participant in the crime. Notably, for these to charges to exist together, the alleged victim must have suffered a physical injury as defined by the law.

Lewisboro Justice Court, located in the Town of Lewisboro, 20 North Salem Road, Cross River, New York 10518 (on the lower level of the shopping plaza), convenes every Monday night at 6:30 p.m., except Holidays. It handles all matters pertaining to Criminal, Vehicle & Traffic, Local Law, Environmental Conservation Law, Westchester County Law, Civil, Eviction, and Small Claims are handled in this Court. Criminal matters, which require the appearance of the Westchester County District Attorney’s Office, are handled bi-monthly.
