DWI, DWAI and DWAI by Drugs

In New York State there are three basic categories of Driving Under the Influence that can result in an arrest. Each is different regarding the consequences of an arrest and each is defended differently. 1. DWI - Driving While Intoxicated - Any motorist who operates a motor vehicle while intoxicated either with a blood alcohol content above a .08 or who refuses a BAC test and appears intoxicated based upon the police officer's observations. If the BAC level is above .18 the motorist will be charged with Aggravated DWI.

2. DWAI - Driving While Ability Impaired - Any motorist who operates a motor vehicle with a BAC reading of between .05 and .07.

3. DWAI by Drugs - Driving While Ability Impaired, while under the influence of a drug - Any motorist who operates a motor vehicle not while under the influence of alcohol but some other drug legal or illegal.

DWI Arrests in Westchester, Putnam and Rockland Counties

Law enforcement will charge a motorist if they fall under any of the above categories, usually after a routine traffic stop or a DWI road block check point.

For example, a Hopewell Junction man was arrested for misdemeanor driving while intoxicated on the Taconic State Parkway in Yorktown and will have to answer the charge in the Yorktown Justice Court in Westchester County.

A Carmel women was charged with operating a motor vehicle while impaired by drugs, a misdemeanor, and unlawful possession of marijuana in Somers. She will have to appear in the Somers Justice Court in Westchester County.

A Nanuet man was charged with misdemeanor driving while intoxicated on the Palisades Interstate Parkway in Clarkstown and will have to appear in the Clarkstown Justice Court in Rockland County.

A Mahopac man was charged with operating a motor vehicle while impaired by drugs, seventh-degree criminal possession of a controlled substance and criminal possession of a hypodermic instrument, and will have to appear in the Yonkers City Court in Westchester County.

A Katonah man was charged with misdemeanor driving while intoxicated in Lewisboro and will ave to appear in the Lewisboro Justice Court in Westchester County.
