Westchester Tickets Are Heard in Local Courts
Unlike New York City and Long Island, where the DMV’s Traffic Violations Bureau hears traffic matters, Westchester County tickets go to the local court in the jurisdiction where the officer wrote the ticket. Harrison, Port Chester, Greenburgh, and Mamaroneck are among the busiest of these local justice courts. Each court sets its own calendar, and our attorneys appear in all of them. The date printed at the bottom of your ticket is the deadline to respond, not necessarily a trial date. Missing it leads the court to have the DMV suspend your license or your privilege to drive in New York.
In Most Cases, You Never Set Foot in Court

What a Conviction Costs You
Pleading guilty or paying the ticket by mail triggers penalties from three directions at once: the court, the DMV, and your auto insurer. A guilty plea also creates a record that an injured party can use as proof you caused an accident in a personal injury lawsuit.
The consequences can include:
- Fines and surcharges: Court fines combined with New York State mandatory surcharges reach into the thousands of dollars.
- Points: Every moving violation carries points. Drivers licensed in other states receive points against their privilege to drive in New York.
- Driver Responsibility Assessment: Six or more points within 18 months costs $100 per year for three years, plus $25 per year for each point above six. A chemical test refusal brings $250 per year for three years. These assessments apply on top of fines, even to out-of-state and unlicensed drivers.
- Insurance increases: Moving violations such as speeding, passing a stopped school bus, following too closely, failing to yield, and running a stop sign or red light raise premiums, usually at renewal. No-point equipment violations generally do not.
- Suspension or revocation: A specific violation or an accumulation of points leads to suspension, and certain violations bring full revocation, forcing you to reapply for a license from scratch.

When a Traffic Ticket Becomes a Criminal Case
Most Vehicle and Traffic Law charges are noncriminal infractions, but some are crimes. The most common are DWI, driving without insurance, and driving with a suspended license. Aggravated Unlicensed Operation under VTL 511 is an unclassified misdemeanor heard in criminal court, with penalties ranging from a fine to probation or jail. A conviction also adds “negative units” to your DMV record, which lead to an extended revocation. Criminal traffic charges can result in a warrant if you fail to appear.
