  • CPS Finding Amended to Unfounded CPS Case Successfully Challenged Before Fair Hearing

    Proto, Sachs & Brown, LLP successfully secured an amendment of a CPS Indicated Finding to Unfounded, resulting in the matter being sealed. Immediately before a scheduled Fair Hearing, the Department of Social Services agreed that allegations of inadequate guardianship based on a parent briefly leaving two children unsupervised in a car should be withdrawn.

    Attorney Andrew Proto argued that the children were never in danger nor likely to be in danger, a fact supported by the case worker’s own notes. He also presented proof that the parent had instructed a supervisor to watch the children, further confirming there was no risk.

  • DMV Refusal Dismissed; License Restored DMV Refusal Hearings

    In two separate DMV refusal hearings, Proto, Sachs & Brown, LLP proved that there was insufficient evidence of a refusal to submit to a chemical test. The DMV Administrative Law Judge found the police paperwork inadequate in both cases and ordered the return of each client’s license, preventing a year-long revocation and DMV administrative surcharges.   • Early DWI Probation Discharge DWI Probation – Westchester County

    Proto, Sachs & Brown, LLP successfully obtained an early discharge from DWI probation for our client in Westchester County, NY. After filing a motion with the County Court and presenting arguments to the Probation Department and District Attorney, the Court agreed that our client had completed the majority of his obligations, had no violations, and no longer needed community supervision. He was discharged early with no further Court intervention.

  • Case Dismissed Court Dismisses Alleged Violation of Conditional Discharge in Westchester County

    After a full hearing, a local Westchester County court dismissed a violation of conditional discharge that had been brought by the District Attorney’s Office. The client had previously pled to a Driving While Ability Impaired (DWAI) charge and was later rearrested for Driving While Intoxicated (DWI) in another state.

    Attorney review showed that the out-of-state case was ultimately resolved without a criminal conviction. Based on that outcome, the judge agreed that the client had not violated the original conditional discharge, resulting in the case being dismissed in full.

  • Amended to Unfounded and Sealed CPS Indicated Finding Successfully Amended to Unfounded

    Just before a scheduled Fair Hearing, CPS Attorney Andrew Proto successfully negotiated to have an indicated report amended to unfounded. The report alleged that a mother left her three young children unattended in a vehicle. After Attorney Proto presented evidence to the County Attorney, it was determined that the children were never in danger and that the mother had not acted improperly.

    As a result, the case was amended to unfounded and sealed, protecting the mother’s record and rights.
