STEP-PARENT ADOPTION

On March 8, 2019, Westchester County Family Court Judge Gail Rice signed an Order of Adoption in a matter involving a step-father adopting his 16 year old stepson. The step-father’s attorney, David Sachs, of Proto, Sachs & Brown, LLP, represented the step-father throughout the Adoption process and overcame the legal challenge that arose because the stepson’s biological father could not be located and served with a Notice of the Adoption. This had the potential to prevent the adoption from being approved by the Court.

Attorney Sachs, relying upon statutory law, successfully argued to the Court that the Adoption could proceed without any notice to the biological father because the biological father had not been part of his son’s life for over 13 years.

David Sachs handles all Family Court matters including Adoptions in Westchester and surrounding counties. While most step-parent adoptions are a relatively straight forward process they can quickly hit unexpected pitfalls.
