Client's Sentence of Probation was Terminated Early in White Plains City Court

|

Westchester County, NY

After serving a little of a year of probation for her plea of guilty to Driving While Ability Impaired By Drugs before a court in Orange County with a different attorney, KG retained the White Plains and Peekskill based law firm of Proto, Sachs & Brown, LLP to assist her in having her two year sentence of probation terminated early.

Wasting no time after the firm was retained, one of the firm’s partners, David Sachs, researched, drafted and submitted a legal motion to the White Plains City Court seeking an early termination of KG’s probation. The Westchester County District Attorney’s vigorously opposed the motion. After reading the motion and reviewing the DA’s opposition papers, the White Plains City Court required KG to appear in Court with her attorney David Sachs to hear oral arguments on the motion.

After hearing the strong oral arguments of attorney David Sachs, and the Assistant District Attorney, the Court granted the motion and KG’s probation was terminated early. KG can now move out of state with her husband and daughter where they have plans to continue building their future in a new home.

Many people believe that a sentence of probation cannot be terminated early if the probation officer and the prosecutor disagree with it. This is not the case as was illustrated in KG’s case. In many situations an early termination of probation not only serves to protect the public’s best interests but it also maintains the public’s faith in the criminal justice system.
